Please read these Terms of Service ("Terms") carefully before using Q-Archive software ("the Software"). By downloading, installing, or using the Software, you agree to be bound by these Terms.
The Software is currently in beta and is provided "as is" without warranty of any kind. While we use industry-standard AES-256 encryption, you acknowledge that:

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Q-ARCHIVE DOES NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SOFTWARE IS DONE AT YOUR OWN RISK.
To the maximum extent permitted by applicable law:
IN NO EVENT SHALL Q-ARCHIVE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SOFTWARE; (II) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN; (III) ANY LOST OR FORGOTTEN PASSWORDS; (IV) ANY ERRORS OR OMISSIONS IN THE SOFTWARE.
You agree to defend, indemnify, and hold harmless Q-Archive and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney's fees and costs, arising out of or in any way connected with your access to or use of the Software, your violation of these Terms, or your violation of any third-party rights.
The Software and its original content, features, and functionality are and will remain the exclusive property of Q-Archive. The Software is protected by copyright, trademark, and other laws. Our trademarks may not be used in connection with any product or service without our prior written consent.
We may terminate or suspend your license to use the Software immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
Upon termination, your right to use the Software will immediately cease. Files you have already encrypted will continue to function, but you will not have access to future updates or support.
These Terms shall be governed by and construed in accordance with the laws of the State of Indiana, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Software shall be resolved in the courts located in Indiana.
We reserve the right to modify or replace these Terms at any time at our sole discretion. We will provide notice of any material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Software after any such changes constitutes your acceptance of the new Terms.
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.
